Terms of Service

VelocityPilot Terms of Service

These Terms of Service ("Terms") govern your access to and use of the VelocityPilot email automation platform and related services (collectively, the "Service") provided by VelocityPilot Pty Ltd ("VelocityPilot," "we," "our," or "us"). By registering for, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

1. Acceptance of Terms

1.1 Eligibility. You represent and warrant that you are at least eighteen (18) years old and have the legal capacity to enter into this agreement.

1.2 Agreement. By clicking "Accept," registering for an account, or using the Service, you agree to these Terms, our Privacy Policy, and any additional guidelines, rules, or policies we post on the Service.

2. Changes to Terms

We may modify these Terms at any time. When changes are made, we will update the "Last Updated" date at the top of this page. Your continued use of the Service after we post revised Terms constitutes your acceptance of the changes.

3. Definitions

  • "Account" means your user account for accessing the Service.

  • "User Content" means any email content, data, text, images, or other materials you upload to or generate using the Service.

  • "API Integrations" means any third-party email services (e.g., Gmail, Microsoft 365) you connect to VelocityPilot.

4. Description of Service

VelocityPilot provides automated email classification, draft generation, and brand-aligned response suggestions using artificial intelligence. You may connect supported email accounts via API Integrations and configure rules, templates, and brand settings.

5. User Registration and Account Security

5.1 Registration. To use certain features, you must register for an Account and provide accurate and complete information.

5.2 Credentials. You are responsible for safeguarding your login credentials and for all activity under your Account. Notify us immediately of any unauthorized access.

6. Permitted Use

6.1 Personal and Business Use. You may use the Service for lawful personal or business communications only.

6.2 Compliance. You agree to comply with all laws and regulations applicable to your use, including privacy, anti-spam (e.g., CAN-SPAM, GDPR), data protection, and intellectual property laws.

7. Prohibited Use

You must not:

  • Use the Service to send unsolicited bulk or spam emails.

  • Use the Service to generate defamatory, abusive, fraudulent, or otherwise unlawful content.

  • Reverse engineer, decompile, or attempt to extract the source code of the Service.

  • Impersonate any person or misrepresent your affiliation with any entity.

8. User Content and Privacy

8.1 Ownership. You retain all intellectual property rights in your User Content. By uploading or generating content, you grant VelocityPilot a worldwide, royalty-free, non-exclusive license to use, process, and store that content to provide and improve the Service.

8.2 Privacy. Our Privacy Policy explains how we collect, use, and share information about you. By using the Service, you consent to our data practices described therein.

9. Intellectual Property

All rights, title, and interest in and to the Service (excluding User Content) are and will remain the exclusive property of VelocityPilot and its licensors. The Service is protected by copyright, trademark, and other laws.

10. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, VELOCITYPILOT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VELOCITYPILOT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. VELOCITYPILOT’S AGGREGATE LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES YOU PAID IN THE SIX (6) MONTHS PRIOR TO THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless VelocityPilot, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your use of the Service; (b) your User Content; or (c) your breach of these Terms.

13. Termination

We may suspend or terminate your Account and access to the Service at any time for violation of these Terms or applicable law. Upon termination, your right to use the Service ceases, and we may delete or deactivate your Account and User Content.

14. Governing Law and Venue

These Terms and any disputes arising out of or related to them will be governed by the laws of Victoria, Australia, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Melbourne, Victoria.

15. Dispute Resolution

Prior to initiating any legal action, you agree to contact us and attempt to resolve any dispute informally.
